Welcome to Little Bit Asian Market. The terms “we,” “us,” and “our” refer to Little Bit Asian Market. Little Bit Asian Market operates this website and provides related information, content, features, tools, products, preorder services, and local pickup services to you (collectively, the “Services”).

Our online store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced within them, describe your rights and responsibilities when you visit our website, place an order, or otherwise use our Services.

Please read these Terms carefully. By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.

Section 1 — Access and Accounts

By using the Services, you represent that you are at least the age of majority in your state of residence or that you have permission from a parent or legal guardian.

To browse our store, place an order, or use certain features, you may be asked to provide information such as your name, email address, telephone number, billing information, payment information, and pickup-related information.

You agree that the information you provide is accurate, current, and complete and that you are authorized to provide it.

You are responsible for maintaining the confidentiality and security of your account credentials and for all activity conducted through your account. You may not sell, transfer, assign, or license your account to another person.

Section 2 — Products and Product Information

We make reasonable efforts to display and describe our products accurately. However, product colors and appearance may vary depending on your device and display settings.

Product packaging, labeling, artwork, size descriptions, ingredients, and other details may occasionally differ from website photographs because manufacturers may update their packaging or product information without notice.

Product photographs are provided for identification and general reference. Unless otherwise stated, your purchase is for the individual product described in the listing—not an entire case, assortment, serving suggestion, or any additional items shown in the photograph.

Ingredients, Allergens, and Dietary Information

Product ingredients, allergen statements, nutrition information, preparation instructions, certifications, and dietary claims are supplied by the manufacturer and may change without notice.

Customers with food allergies, dietary restrictions, or other health concerns should carefully review the product’s physical label before consuming or serving it. Do not rely exclusively on photographs or descriptions displayed on our website when making allergy-sensitive or medically necessary purchasing decisions.

If information displayed online differs from the information printed on the product you receive, please follow the product’s current physical packaging and contact us before consuming the product if you have questions or concerns.

We do not manufacture the packaged products we sell unless a product listing expressly states otherwise.

All products are subject to availability. We may discontinue products, correct product information, or limit purchase quantities at any time.

Section 3 — Preorders and Orders

When you submit an order, you are making an offer to purchase the selected products. Your receipt of an order confirmation does not necessarily mean that every item is available or that your order has been finally accepted.

Preorder products are subject to availability from our suppliers. Although we make reasonable efforts to obtain all ordered items, supplier shortages, discontinued products, damaged inventory, transportation delays, or other circumstances outside our control may prevent us from fulfilling part or all of an order.

If an ordered item becomes unavailable, we may:

  • Contact you regarding the unavailable item;

  • Remove the unavailable item and issue a refund for that item; or

  • Cancel and refund the affected portion of the order.

We will not substitute a materially different product without your permission.

Payment must be authorized and successfully processed before an order is accepted. We reserve the right to accept, limit, decline, or cancel an order when reasonably necessary, including because of product availability, pricing or listing errors, suspected fraud, unauthorized payment, quantity limitations, or circumstances outside our reasonable control.

If we cancel an item or order after payment has been processed, we will issue the applicable refund to the original payment method.

Please review your order carefully before submitting it. Because preorder inventory may be purchased or reserved specifically in response to customer orders, cancellation or modification requests cannot be guaranteed after an order has been placed.

Purchases are subject to our Refund Policy.

Products purchased through our consumer storefront are intended for personal or household use and not for unauthorized commercial resale or export.

Section 4 — Prices, Taxes, and Payment

Prices, discounts, product availability, and promotions may change without notice. The price charged will generally be the price displayed when the order is submitted, subject to the correction of genuine pricing or listing errors.

Unless expressly stated otherwise, displayed prices do not include applicable sales taxes. Applicable taxes will be calculated and displayed during checkout.

Promotions may be governed by separate terms and may be modified or discontinued as permitted by law. If separate promotional terms conflict with these Terms, the promotional terms will control for that promotion.

You agree to provide accurate and complete billing, payment, and contact information. You represent that:

  • You are authorized to use the payment method submitted;

  • The payment information is accurate and complete; and

  • Charges associated with your purchase will be honored by your payment provider.

If an obvious pricing or product-information error affects your order, we may contact you for instructions or cancel and refund the affected item or order.

Section 5 — Local Pickup

Little Bit Asian Market currently offers local pickup rather than shipping. The pickup date, location, and available pickup window will be displayed during checkout, included in your order communications, or otherwise provided before the scheduled pickup event.

Customers are responsible for:

  • Providing accurate contact information;

  • Reviewing order and pickup notifications;

  • Arriving at the designated location during the stated pickup window;

  • Bringing the requested order confirmation or identification; and

  • Checking that all items have been received before leaving whenever reasonably possible.

Orders may only be released to the customer named on the order or another person authorized by that customer. We may request order confirmation or identification before releasing an order.

Pickup dates, times, and locations may occasionally change because of severe weather, emergencies, facility restrictions, supplier delays, or other circumstances outside our reasonable control. If a material change occurs, we will attempt to notify affected customers using the contact information provided with the order.

If you cannot collect your order during the scheduled pickup window, contact us as soon as possible at littlebitasianmarket@gmail.com. Alternate pickup arrangements are not guaranteed.

Failure to pick up an order does not automatically cancel the order or qualify it for a refund. Any refund eligibility will be determined according to our Refund Policy and applicable law.

After an order has been released to the customer or the customer’s authorized pickup person, the customer is responsible for properly transporting, storing, refrigerating, or freezing products as required.

Section 6 — Food Safety and Product Recalls

Customers should inspect their orders promptly after pickup and follow all storage, refrigeration, freezing, preparation, handling, and use instructions printed on the product packaging.

Do not consume a product if its packaging is open, leaking, unusually swollen, materially damaged, or otherwise appears unsafe.

If you believe an item was damaged, spoiled, past its marked expiration date at pickup, incorrectly supplied, or subject to a safety concern, contact us promptly according to our Refund Policy.

If we become aware of a product recall affecting an item sold through our store, we may attempt to notify customers using available order records. Customers should follow all recall instructions issued by the manufacturer or appropriate government agency.

Section 7 — Intellectual Property

The Services—including our business name, branding, logo, mascot, website design, original text, graphics, photographs, videos, and other original content—are owned by Little Bit Asian Market or used with permission and are protected by applicable intellectual-property laws.

These Terms permit you to use the Services for personal, noncommercial purposes only.

You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit our original materials without prior written permission, except as permitted by law.

Nothing in these Terms grants you a license or ownership interest in the intellectual property of Little Bit Asian Market, Shopify, product manufacturers, or other third parties.

Product names, packaging, logos, and trademarks belonging to manufacturers or suppliers remain the property of their respective owners.

Section 8 — Optional Tools

We may provide access to tools, features, payment services, or other functionality offered by third parties. We may not monitor or control these third-party services.

Third-party tools are provided on an “as available” basis and may be governed by the third party’s own terms and privacy practices. Your use of those tools is at your discretion and risk.

We may introduce additional tools, resources, or features in the future. Those features will also be considered part of the Services and subject to these Terms.

Section 9 — Third-Party Links

The Services may contain links to websites, content, or services operated by third parties.

We are not responsible for evaluating or guaranteeing the accuracy, availability, security, or content of third-party websites. If you choose to access a third-party website, you do so at your own discretion.

We are not responsible for losses or damages arising from purchases, services, resources, or content obtained directly from third parties. Please review the third party’s terms and policies before completing a transaction with it.

Questions or complaints concerning third-party products or services should generally be directed to the applicable third party, except when your concern relates to a product purchased directly from Little Bit Asian Market.

Section 10 — Relationship With Shopify

Little Bit Asian Market is powered by Shopify, which enables us to provide the Services to you. However, purchases made through our store are transactions directly between you and Little Bit Asian Market.

By using the Services, you acknowledge that Shopify is not the seller of the products offered by Little Bit Asian Market and is not responsible for our products, order fulfillment, pickup events, refunds, or customer-service decisions.

To the fullest extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising directly from purchases and transactions between you and Little Bit Asian Market.

Section 11 — Privacy

Personal information collected through the Services is handled according to our Privacy Policy.

Certain information may also be collected and processed by Shopify according to Shopify’s Privacy Policy.

Because Shopify hosts our online store, information submitted through the Services may be transmitted to and processed by Shopify and other service providers that help us operate our website, process payments, communicate with customers, prevent fraud, and fulfill orders.

Section 12 — Feedback and Reviews

If you voluntarily submit a review, photograph, suggestion, idea, comment, or other content to us (“Feedback”), you grant Little Bit Asian Market a nonexclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and adapt that Feedback for operating, improving, and promoting the Services.

You represent that:

  • You own or have permission to submit the Feedback;

  • Your Feedback is truthful and based on your genuine experience;

  • You have disclosed any compensation or incentive connected to the Feedback; and

  • Your Feedback does not violate another person’s intellectual-property, privacy, publicity, or other legal rights.

You may not submit unlawful, abusive, defamatory, threatening, obscene, fraudulent, or misleading content or content containing malicious software.

We may monitor, edit, decline to publish, or remove Feedback that violates these Terms or applicable law. We are not obligated to keep Feedback confidential, pay compensation for it, or respond to it.

Occasionally, the Services may contain typographical errors, inaccurate information, or omissions involving product descriptions, photographs, package sizes, ingredients, prices, promotions, availability, pickup instructions, or other information.

We reserve the right to correct errors, update information, or cancel and refund an affected item or order when reasonably necessary, including after an order has been submitted.

Nothing in this section limits any rights or remedies available under applicable law.

Section 14 — Prohibited Uses

You may use the Services only for lawful purposes.

You may not use the Services to:

  • Violate any applicable law or regulation;

  • Infringe the intellectual-property or legal rights of another person;

  • Submit false, fraudulent, abusive, threatening, defamatory, or misleading information;

  • Impersonate another person or misrepresent your identity;

  • Interfere with the operation or security of the Services;

  • Introduce viruses, malicious code, or other harmful technology;

  • Collect or track another person’s private information without authorization;

  • Engage in spam, phishing, scraping, or unauthorized data collection;

  • Circumvent security, access-control, rate-limiting, or fraud-prevention measures; or

  • Use the Services in a manner that harms Little Bit Asian Market, Shopify, our service providers, or other users.

We may suspend or terminate access to the Services if we reasonably believe these Terms have been violated.

Termination does not eliminate amounts properly owed or obligations that arose before termination.

Sections that by their nature should continue after termination—including intellectual property, feedback, disclaimers, limitations of liability, indemnification, severability, governing law, and privacy provisions—will remain in effect.

Information presented through the Services is provided for general informational and shopping purposes.

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis without warranties or representations that the Services will always be uninterrupted, secure, error-free, or available.

Products manufactured by third parties may be subject to warranties, instructions, and representations provided by their manufacturers.

Nothing in these Terms excludes or limits any warranty, consumer protection, food-safety obligation, or other right that cannot legally be excluded or limited.

Section 18 — Limitation of Liability

To the fullest extent permitted by applicable law, Little Bit Asian Market and its owners, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of the Services.

This may include, without limitation, lost profits, lost revenue, loss of data, replacement costs, or similar damages.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from fraud, willful misconduct, or other matters for which liability cannot be waived under applicable law.

Section 19 — Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Little Bit Asian Market, Shopify, and their respective affiliates, employees, contractors, service providers, and licensors from third-party claims, liabilities, damages, and reasonable legal expenses arising from:

  • Your material breach of these Terms;

  • Your unlawful use of the Services; or

  • Your violation of another person’s legal rights.

This section does not require you to indemnify any party for conduct for which indemnification cannot lawfully be required.

Section 20 — Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

Section 21 — Waiver and Entire Agreement

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms and the policies incorporated by reference constitute the entire agreement between you and Little Bit Asian Market concerning your use of the Services and replace prior communications or agreements concerning the same subject.

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations in connection with a reorganization, merger, sale, transfer of assets, or other lawful business transaction.

These Terms and any separate agreements through which we provide the Services are governed by the laws of the State of Louisiana and applicable federal law, without regard to conflict-of-law principles.

Any legal proceeding concerning these Terms or the Services will be brought in a court with proper jurisdiction and venue in Louisiana, except where applicable law provides otherwise.

Section headings are provided for convenience only and do not limit or otherwise affect the meaning of these Terms.

We may update these Terms by posting a revised version on our website. Material changes will become effective on the date stated in the updated Terms or as otherwise required by law.

Your continued use of the Services after updated Terms become effective constitutes acceptance of those changes, to the extent permitted by law.
